Types Of Grand Larceny

The state of New York stratifies grand larceny into four degrees based on severity and circumstances of the crime. Other federal and state consequences may vary.

Fourth Degree — Grand larceny in the fourth degree is an act wherein property is taken directly from an individual and consists of property valued over $1,000; credit or debit cards; or other theft including documents and firearms. Sentences at this level may include fines, probation and community service. If you are not a first-time offender, the minimum sentence includes 1.5 years imprisonment.

Third degree — Grand larceny in the third degree includes stolen property valued between $3,000 and $50,000. Sentences at this level may include fines, probation, and community service. Associated prison sentences are between two and seven years incarceration.

Second degree Grand larceny in the second degree includes property valued between $50,000 and $1 million. Sentences at this level includes incarceration for between five and 15 years, including first-time offenders.

First degree — Grand Larceny in the first degree includes stolen property valued over $1 million. Sentences at this level are determined by case and include up to 25 years of jail time.
